San Diego Superior Court Judge Yuri Hofman says the new state law giving control of the beach to the city council warrants a hearing on the issue. The October court date will address the original 2005 decision that mandated the city return the Children’s Pool to its pre-seal condition. City Attorney Jan Goldsmith spoke with reporters outside the courtroom after the judge ruled.

“The whole purpose of this is to end the expensive litigation that’s gone on for to many years. Stop the bleeding of the costs. Stop the bleeding of the expenses and the attorney’s fees and get this back into the hands of the policy markers,” he says.

Goldsmith says allowing the seals to stay on the beach would be justice for taxpayers because the process of restoring the Children’s Pool could be expensive for the city.
