A judge has ruled that the University of California, San Diego's disciplinary action against a student accused of sexual misconduct was unfair and not supported by evidence.
The San Diego Union-Tribune newspaper reported Monday that the student, who had faced a suspension of one year and a quarter, will be allowed to remain in school under the ruling handed down by Superior Court Judge Joel Pressman.
The undergraduate named only as John Doe claimed in a lawsuit that he had been wrongly accused of sexual misconduct by a female student, and that the university had unfairly investigated the case.
The judge wrote that the school refused to allow the male student to fully confront and cross-examine his accuser.
The school issued a statement that it was evaluating the decision and considering whether to appeal.
