this is interesting and I would be interested in a third party legal analysis - I am not attorney, but I am thinking that the City, as an entity, protects itself, or limits damages to some degree, by taking action against the harasser, correcting the situation as soon as it becomes aware that harassment has occurred - while it appears that McCormack Jackson was subjected to inappropriate behavior- she still has city job, and the harasser has been eliminated - I think the claim will possibly still valid, has less financial value - the city then might agree to take on legal costs, thinking that damages have been mitigated has they got rid of the harasser -- Allreds incentive is to have Filner hanging out on his own so that he doesn't have resources to fight her claim, and more incentive to settle early while the city can now claim that it took action against the harasser like it is supposed to do- I don't believe any additional retirement benefits etc will be thrown in or can be thrown in; I think he already has a city retirement from his city council days, and his new higher salary, if even for a partial year, may spike it slightly, but that would be by formula & politicaly it would be very stupid for them to throw in any other financial goodies for Filner besides releasing him from legal liability. Good riddance ,and from a legal prospective, prolly well played by Goldsmith - he beats Filner & Allred in a way - For Jackson, I think she deserves something for sure for having to put up with what she did - some cash for that and some employment protection guarantees- again good riddance of Filner

Will The Filner Scandal Cause An Economic Fallout In San Diego?

it seems like one of the most basic jobs of a Mayor is to be the face of the city for economic development purposes; to be a visionary on this front; to be a cheer leader of this business community -- Cities compete for companies and the Mayor would play a key role in such competitions-- this is aside from the regular admin duties related to the strong mayor form - Filner cant do these basic economic duties - he has become a pariah - it seems no one would even want him to cut a ribbon, be seen with him or be in a picture with him regardless of due process - private companies are sensitive to PR, sensitive to the message that they want to portray to their employees and Filner provides no upside to anyone on this front - the shame is that his key constituents need jobs, need a solid economic base

The Legal Issues Surrounding Mayor Filner And Sexual Harassment Allegations

@Marine Room; I appreciate your comments and mostly agree on the day to day operations front; I believe most city employees are public servants who want to provide effective services, and that a huge chunk of city services are apolitical, they go on regardless of what is happening in the top dog seat ;

I guess the chaos I refer to is the leadership void and the jockeying for positions, the negative media attention; the overall media attention over riding other issues that deserve attention; the time and energy of City staff going towards related issues like the law suit and other claims; the employees feeling shell shocked and per Eckhard; Federal Investigation; dissension and division of the City Council; loss of overall credibility of the Mayors office

it is hard for any agenda to go forward with a leadership void and loss of credibility; and those phrases may better describe my concern rather than chaos- if there are sharks waiting in the wings ready to hijack that seat, that is no surprise to me vs being a political reality, or just politics in general - but I can only think that Filner is aiding and abetting with the hijacking if that does indeed occur. Meanwhile many people who support a progressive agenda, and fear what you mention are put in the position of having to make the best choice of whats best overall in the big picture; and people like Donna Frye , Lorena Gonzales etc want the Mayor gone - I personally wish they were never placed in that position.PEACE

The Legal Issues Surrounding Mayor Filner And Sexual Harassment Allegations

Besides the allegations made people who claim that they were harassed, or on the receiving end of otherwise inappropriate behavior - Let's remember that Mayor Bob himself admits to treating women inappropriately; that he intimidates women, that he is "huggy"; that his actions may reflect a bygone era; that he has some kind of monster inside of him; that his personal behavior issues are so inappropriate and intrusive that he needs to leave the city he helms for two weeks of intensive therapy - for me, he is really saying he is not able to be Mayor by his own comments-- and this self analysis only came forth after brave women came forward. At the same time he is saying he is innocent and various claims are not valid - confusing ??

so per Bob, he's an innocent huggy monster from the Madmen days who intimidates women, requiring major residential psychological treatment, and none of the women who happen to be making claims have any validity to what they are saying ?

this Dem thinks the city is in chaos and that the right thing is for this guy to resign to save the city from all of this mess

Former San Diego COO: Mayor's Office Canceled Harassment Training

Filner's lawyer's argument might be relevant for a lower level employee, but as the Strong Mayor/CEO, Filner would ultimately responsible for the enforcement of all City policies & procedures. A subordinate coordinator-position type employee could not make or force the top executive to engage in the training, whereas other employees could be directly ordered to take the training if they for some reason were not addressing it by their own accord per the City's policy. Also, a narcissist would tend to avoid the training from the standpoint of they don't need it, its a waste of time, because they kinda know everything, in a delusional sense.

8th Woman Accuses Filner Of Unwanted Sexual Advances

more great work by KPBS - KPBS is doing something right whereby people are feeling comfortable going to them to speak of these horrible experiences.

its not he said , she said by any means - he said, she said, she said, she said, she said, she said, she said, she said, she said - with corroborative evidence such as this persons staff who she informed immediately, or the email from Ms Fink -

you can also add two more he said, he saids in terms of Filner seemingly twice admitting that he has a problem with how he treats women

The veil of holding back so that Filner can somehow enjoy due process promoted by some, is wearing thin. Due process is an American ideal that we all expect. We can we argue against this for him?

Well Filner has now twice admitted inappropriate behavior specifically against women. Do we really need to hash out the tawdry details of each specific incident/claim?

my analogy is this: If a person says I have had a problem with stealing; I really need some help and counseling to address this problem with stealing; there is a monster inside me that likes to steal.

Do we then really need due process to determine that this person is a thief?

Do we then need attack the credibility of each person who says the admitted thief stole from them? For Filners alleged misdeeds, the formal lawsuits will otherwise allow for gauging credibility as needed. But do you really want to subject San Diego to this or to the due process of a recall election?

The City has become a daily reality TV program. The house is crumbling. Anyone who is still supporting this guy needs to do what they can to get him to resign before he starts therapy to save the city from this continued drama

Filner Announces He Will Enter Counseling Clinic; Says Nothing Of Resigning

of note as well - is his this announcement as another flip flop in terms having any shred of integrity - his first video statement admits some level of guilt & responsibility -- he then makes statements re: how with due process he will be found innocent -- then statements about claims not being valid -- now back to I need help, I am a bad boy with a psychological problem -- every step is calculated , and I must add, poorly-- the first admission was probably meant to appease Frye et al, betting that accusers would not come forward; then he dug heals in with the "due process" PR tagline to buy time, then attacking the first victim who came forward, with her claims not being valid, as she was the only one -- then after more came out, people like Admiral Froman, there is some realization that I cant attack all these people as liars, so now he is back to " I did bad things, I need help" - he should be out of office for his inappropriate behavior -- and for his flip floppy response to the charges. he really is showing that he is totally unfit for office.

Filner Announces He Will Enter Counseling Clinic; Says Nothing Of Resigning

he obviously needs therapy - but this is mostly likely going to be a lifelong pursuit/maintenance program - if he is truly narcissistic as was implied by the psychologist whom he allegedly forced himself upon, the narcissism is usually considered an engrained personality trait- I support him doing this work BUT on his own time as a private citizen - I also think that there is a dynamic at work whereby all is closest supporters and advisors all have a stake in keeping their jobs etc by doing anything possible to try to keep him in office; so besides what may be his own narcissism keeping him from resigning we have other people with a financial stake involved advising him to hang on, and the two week therapy effort is designed to defer resignation when for all intensive purposes he has lost all credibility as a leader -the recall effort therefore has to proceed post haste - there also needs to be a charter amendment somehow allowing for a Mayor to be removed when somehow deemed to be mentally impaired or grossly violating policies, without having to go through the recall process, and that new process should not necessarily be easy, but more efficient than a recall process. I wish him well with treatment as a private citizen. I want him out of office ASAP.

Filner Harassment Scandal Grows As Second Woman Comes Forward

I think this is just the start - my feeling is that Marco, Frye & Briggs were actually trying to get Filner to resign before all the tawdry, inappropriate, discriminatory details came out , either through formal due process proceedings or other public unveilings. Marco et al said Filner would write the next chapter and the next chapter is the gradual release of information and lawsuits - I believe they confronted him personally first, then jumped it up a notch with their press conference to show they were serious - and now the charges unfold - the lawsuit is serious with a very credible claimant - as far the second womans claim being old - I believe it is just presented to show a pattern of behavior plus she was smart enough to document it- that took courage to send that email back then-- I believe the more that come forward the better, old or new charges because a definite pattern of behavior is shown here, in addition to Filners own videotaped self admission to inappropriate behavior - and the more that come forward will help others to come forward - this guy is looking like a classic narcissist - they don't change behavior, they fight to the death with some distorted thinking that they have done nothing wrong- even when their behavior was brazen - and they do hold grudges as mentioned by this second young lady; they just don't want to beat their enemies, they want to crush them- I am a Dem and I want this guy out of there yesterday
