Law Enforcement Raids Marijuana Dispensaries

7)I am almost 50 years old. I have no criminal record. I was tricked into helping another legally valid medical marijuana patient who happened to be an undercover cop, who at the direction of the district attorneys office in San Diego, went and lied to a doctor about his symptoms to obtain a valid recommendation, then spent months, and (from my estimate) over 2 million dollars of YOUR HARD EARNED TAX MONEY, entrapped as many people as they could in the medical marijuana community. This was last February, prior to these store raids, and I am still stumbling through their court system. They then committed a swat style raid (75k for just my house)stormed my home, pointed assault rifles at me, destroyed my home, took me to jail, are dragging me through the court system (even though the courts are supposedly broke and have to close one day a week. (I have no criminal record and I am facing day to day life threatening illness. At this time, part of my liver is "nodulated", the other part enlarged. I need to call the doctor to schedule what will almost for sure be my 3rd skin cancer surgery.) If they want to send me off to prison, to prove a point, will the taxpayers pick up the tab for my liver transplant? I have spent my life following the law. And now I am caught in the middle of a POLITICAL firestorm, the depths to which I could not even comprehend before my arrest. My trial is set for December 7, 2009 (At taxpayer expense)If they put me in jail, will they guarantee me the proper medical care? My immune system is virtually non-existent from the chemotherapy and the sjoegrens disease. And by the way, I do not believe I did anything wrong. I helped another patient.
Profit?? Interesting. The judge at my preliminary hearing stated that I was clearly not in it for profit. So please call the DA and ask why is Donna Lambert being put on trial for 7 felonies if the judge ruled she was not in it for profit and they want to claim profit is the issue with these stores, the cannot have it both ways. Just want to get high? - hmm - Guess the Hep C, Cirrhosis,Cancer,chemotherapy, sjoegrens disease and the injuries from the car accident I was in did not stop the DA from trying to get the judge to throw out my medical marijuana status so that they could try me as a common drug dealer. (This is standard in all medical marijuana cases.) Fortunately, they did not succeed.
It is not the fault of a collective operator if government agents lie to doctors (medical fraud) and presented themselves as legitimate patients in need of finding a collective to join.

Law Enforcement Raids Marijuana Dispensaries

I would like to address some propaganda and misstatements that are regularly put out in order to legitimize the illegal harassment of medical marijuana patients and the medical marijuana community at large.
1) Most of the people who speak out against medical marijuana are receiving grants from either the County of San Diego or from pharmaceutical funded "anti-drug" groups whose sole purpose is to prevent access to medical marijuana as prescribed by law.

2)Marijuana has many well known medical effects, of which there are dozens of studies on the internet, most often done in Europe where the pharmaceutical companies do not control the government, as they clearly do in America.

3)It is easy for a local government official to make a statement that is a total lie, such as "they were making a profit" or "they were selling outside their collective". The general public then accepts it. From my personal experience, I can tell you these are boldface lies, and people should question everything they read or hear. The reality is that the government obtains valid medical recommendations and then joins the collectives. Also, all "non-profits" are allowed to make money to pay for overhead, expenses, salaries and the like. If someone was not open long enough to pay their taxes to the state (which does issue medical marijuana sellers tax permits), how can the county come in and slander people this way?

4)A majority of voters passed prop 215, 13 years ago, legalizing marijuana for medicinal use. In 1994, the legislature, with sb420 provided exemption for sales and all sales related charges. The senate bill archives state that the intention of sb420 is to facilitate the safe and affordable distribution of marijuana for medical use. This law states that we are allowed to "collectively associate" for this purpose.

5)The previous administration wanted to use San Diego as a staging ground to try and overturn state law. Political promises were made.

6)San Diego has wasted millions of your taxpayer money in an effort to turn over medical marijuana laws, simply because this is a plant with real value, and would cut into pharmaceutical company profits

San Diego Hazy About Medical Marijuana Rules

A task force is definately needed. It has been 13 years since the voters in the State of California voted to legalize marijuana for medicinal use. From the senate bill archives to the attorney general guidelines, it is clear that sb420 attempted to make way for the distribution of medical marijuana.
Kudos to Marti Emerald for standing up for what is right, in a County that has spent millions of dollars to undermine this state law.
Limiting the number of dispensaries is NOT the answer. This only leads to high prices as patients are forced to purchase from a limited number of people. Further, collectives are legal, it is not a matter of how many people can get together to form collectives. The answer lies in zoning, regulation, and taxation. Over 50 cities have set up zoning guidelines, so nobody needs to re-create the wheel here. Logic shows that dispensaries are typically zoned away from schools, churchs, and parks. Dispensaries in the bay area pay MILLIONS of dollars in taxes every year.
I find it ironic that while the city is talking about how to safely dispense medicine, the narcotics task force, operating under the direction of the district attorney's office is STILL using undercover officers who lie to doctors about their symptoms to obtain medical marijuana cards, to go about joining collectives and co-ops to make purchases so that they can arrest people.
I have worked collectively with a small group of people. A police officer who lied to a doctor about his symptoms to obtain a valid medical marijuana rec purchased medical marijuana from me after having me verifiy that he was a patient AND explaining to me that he was staying at his brother in laws and looking for his own place. For helping this man twice, I experienced a swat style raid, had my home torn up, was taken to jail, and I am facing trial on seven felonies. Meanwhile, I have no criminal record, started using medical marijuana while on chemotherapy, and I am under constant medical care. Estimated cost to taxpayers on this Operation GreenRx attack against the medical marijuana community is over 2 million dollars and counting.
Is our local government like the many arms of an octopus, where each one is doing its own thing without regard to the others? Why am I facing trial, when as of last month there were at least 60 stores known to be open?
Why is our District Attorney wasting endless taxpayer dollars to attack and try people in the medical marijuana community when the law clearly states that we can "collectively associate" and be exempt from sales and all sales related charges?
Please make phone calls to Bonnie Dumanis (619)531-3784 and ask her office to start working with the medical marijuana community. Please ask them to drop the case against Donna Lambert (ACL004). On a larger level, please remind her that the people of the state of California have voted, Medical marijuana has a 70-90% voter approval rating. Thank You.

Administering Medical Marijuana Laws in San Diego

I am a 46 year old woman who has learned about the beneficial effects of marijuana while on chemotherapy . While I am still sick now, I attended support groups and helped other patients to get their medicine at the lowest cost possible. I did this because I saw some people being taken advantage of and it bothered me.
So the police went and fraudulently obtained a medical marijuana card and spent 6 months specifically targeting medical marijuana patients and providers. I have proof of this. I was caught up in the mix of those arrested.
Now I am having my life destroyed. At age 46 I have no criminal record and am under the clear impression this was legal under California law.
It is sad to me to see that my government is really not a democracy at all. I have become aware that the government refuse to accept the will of the people, the voters. 70% of San Diegans approve of medical marijuana and 92% statewide. These numbers are equally spread between democrats and republicans.
It is a sad awakening for me in a City that I used to love and a Country I used to believe in.
If you are thinking what a waste of taxpayer money this is, I have more. The chemotherapy triggered an autoimmune disease called Sjoegrens, for which I must receive regular medical treatment. And my immune system is so destroyed by this and the Hepatitis C and the chemotherapy, that I get sick very easily. I catch any minor cold that I am exposed to and where others are in bed for 2-3 days, I will be bedridden for a good two weeks. I have chronic pain from a serious car accident, I am into the 4th and final stage of cirrhosis
I am very afraid that if I am put in a jail with many other people I could easily catch something and die. I do not mean to be dramatic but I truly do believe I am facing a death sentence by the San Diego Court.
Will putting me in prison for medical marijuana benefit society in any way? Is it worth the taxpayer money of incarceration and the additional taxpayer money of medical care and a potential liver transplant. Will they be responsible enough to make sure to provide my 3rd skin cancer surgery? Oh yes, I have skin cancer, too.
Do you, the taxpayer, believe that this is a good use of your taxpayer money? Is the satisfaction these people receive from destroying my life a good exchange for a full time school teacher for one year? I do not believe so. And I really need your help. Honestly, I am extremely scared. If each person reading this who felt at all like what happened to me is not okay, I would so much appreciate you taking the time to call anybody in your local government and tell them about it.
