The whole thing is very sad. Mr. Hernandez had lived in San Diego for more than 25 years, since he was 14 or 15. Unlike other offenses, entering without papers doesn't go away when you reach adulthood, and there is apparently no statute of limitations. There was no way for him to legalize his status. He had been torn away from his home, his wife and his children, and got caught trying to come back. I can't imagine anybody in his circumstances NOT trying to escape.

The problem with having excessive laws is that it puts you in the position of having to use force to make people comply. With tragic results in this case.

How To Rescue the Golden State from the Junk Heap

My understanding is that the vast majority of the budget is out of the legislature's hands. Either voter initiatives or federal grants have mandated spending most of the money in specific ways. The main problem with voter initiatives are that things are decided piecemeal -- are you for this or against it? -- without being able to weigh things in terms of the budget and other priorities. Until we have some kind of change to the initiative process, I am afraid no other changes will be enough.

So reforming the voter initiative process would be the top item on my list.
