The governor DID create confusion with his signing message stating that CA would only recognize same-sex marriages from out-of-state if they were performed in the 5-month window.
The governor's comment is incorrect.
Hieu's comment is also incorrect.
The legislation explicitly states that out-of-state same-sex marriages performed BEFORE November 5, 2008 will be recognized in CA.
The confusion is that they do not have to be performed in the 5-month window period. They only have to have been performed before Prop 8 passed.
The very simple logic is this: same-sex couples married in other jurisdictions could not remarry in CA during the 5-month window, no matter when they actually married. So to be on par with marriages performed during the 5-month window, the state must legally recognize those marriages as well.
