San Diego City Councilman Jim Madaffer is taking issue with the latest lawsuit filed by City Attorney Mike Aguirre. KPBS Reporter Amita Sharma has more.
Last week, Aguirre sued former pension plan lawyer Lori Chapin. He accused her of using her post as a deputy city attorney 10 years ago to push the retirement system to create a general counsel job. The lawsuit alleges that Chapin's goal was to secure that position for herself.
Aguirre argues that Chapin violated California's conflict-of-interest rule which bars officials from having a financial stake in contracts they make during their job.
Chapin's lawyer calls the lawsuit frivolous and believes it will be dismissed.
But Councilman Jim Madaffer is worried Chapin will file a malicious prosecution lawsuit that could cost the city a lot of money in punitive damages. In a memo to colleagues, Madaffer said the city should not be responsible because it never authorized Aguirre to file the claim. Aguirre did not return calls seeking comment. Amita Sharma, KPBS News.
