Barton: "This city has a rendezvous with destiny with regard to this pension plan, and we are looking at a 6 billion dollar liability there is still time to save the system."

Aguirre asked the court to appoint an expert to identify what he called "the cancer of illegal benefits" and cut them out. But labor attorney Ann Smith scoffed at Aguirre's suggestion.

Aguirre: "When the city attorney says there should be a scalpel taken to the benefits, I have no idea your honor what he is even talking about it has never been defined what benefits are actually being put in issue."

Judge Barton said the case is legally very complex and that he'll time to reach a summary judgment. Alison St John, KPBS news
