Governor Kills Medical Marijuana Measure

Governor Schwarzenegger has vetoed a bill aimed at providing job protection for medical marijuana users. The measure would have prohibited employees from being fired for testing positive for marijuana they used with a doctor's approval. KPBS Reporter Kenny Goldberg has more.

The bill would have overturned a state Supreme Court ruling on California's medical marijuana law. The court said the law was not designed to prevent employers from firing workers for violating federal drug statutes.

In his veto message, the governor agreed that employment protection was not part of the initiative voters approved 12 years ago.

Dan Bernath : I think it's ridiculous to think that the voters of California wanted patients to use this medicine if their doctors recommended it, but did not want them to be able to be employable.

Eleven other states have medical marijuana laws. Rhode Island is the only state with employment protection written in the law.
