High Court Hears Abortion Ban Case

A federal law banning so-called partial birth abortion is now in the hands of the U.S. Supreme Court, a day after the court heard arguments over the law.

Six years ago, the high court struck down a similar state ban. It declared that the law was an unconstitutional burden on a woman's right to have an abortion because it did not have an exception to protect the health of the mother.

Three years later Congress enacted a new ban. This time the law stated that the partial-birth procedure is never medically necessary.
