Prosecutors will appeal the dismissal of a case against a Marine officer charged with failing to investigate the shootings of 24 Iraqis.

A military judge dismissed charges earlier this week against Lt. Col. Jeffrey Chessani after finding that an investigator improperly influenced a four-star general overseeing the case. Prosecutors filed a notice of intent to appeal yesterday and have 20 days to file a written appeal that spells out why they disagree with the judge's decision.

The filing does not reveal on what grounds prosecutors will appeal the ruling.

The case, which stems from the November 2005 shootings by a Marine squad in Haditha, Iraq, will be delayed indefinitely because of the appeal.
