Embattled Camp Pendleton Marine Sgt. Gary Stein, recommended for discharge from the service for writing Anti-Obama Facebook posts, lost his bid today in federal court to have that discharge halted.
Stein has said previously he plans to fight his discharge all the way to the U.S. Supreme Court. Indeed, on his Facebook page he wrote minutes ago:
"The court hands it off to the 9th circuit."
While it's ultimately up to the Commanding General of MCRD San Diego to make the final decision on Sgt. Stein's discharge, a Marine administrative board recommended last week that Stein be dismissed from the service with an Other Than Honorable discharge.
