Legal Update: ‘Under God,’ Poway Nooses, and the Supreme Court

Tom Fudge: The "under God" case is back in the courts. A couple of weeks ago, atheist and lawyer Michael Newdow was back before the 9th Circuit Court of Appeals telling judges that the Sacramento School District was violating the separation of church and state clause of the Constitution. They were doing it by telling kids to say "one nation, under God" in the Pledge of Allegiance. At the U.S. Supreme Court, meanwhile, the justices struck a blow for judicial independence by holding up the decision of an Iowa judge who didn't follow sentencing guidelines in a crack cocaine case.
