A Camp Pendleton Marine is charged for a second time with murdering an Iraqi detainee. Sgt. Jermaine A. Nelson is one of two Marines accused of shooting at a group of unarmed men back in 2004. KPBS reporter Andrew Phelps has details.

The shooting occurred during heavy fighting in Fallujah. Nelson is accused of murdering one of the captives. Squad members say they were under fire from a nearby house.

Nelson is also accused of being derelict in his duty to follow the rules of engagement.

The Marine will face a court-martial if an officer decides there’s enough evidence for trial.

This is the second time Nelson faces charges. A Marine Corps general at first dropped charges to review his case more carefully.

Nelson’s squad leader, Jose Nazario Jr., faces charges of voluntary manslaughter in Riverside federal court, because his military tour has ended.
