Judge Hears Arguments Over President Bush's Navy Sonar Waiver

A federal judge Wednesday heard arguments over whether President Bush can exempt the Navy from environmental laws. The Navy wants to continue its sonar training off the San Diego coast without restrictions to protect marine mammals. KPBS Reporter Ed Joyce has more.

Earlier this month, Bush signed a waiver, exempting the Navy from environmental laws while it conducts sonar testing. Bush's waiver effectively overrode U.S. District Judge Florence-Marie Cooper's preliminary injunction. The Judge had set limits on the use of sonar. Environmental groups say the sound waves hurt dolphins, whales and other marine mammals. They also say Bush's exemption was unconstitutional and set a dangerous precedent.

Navy officials say the tests are crucial in training sailors to detect quiet submarines.

The Navy's next round of sonar exercises are set to begin in March and continue through early next year.

Judge Cooper's ruling is expected within a week.
