The Orange County District Attorney's office says the fatal shooting last February of a 31-year-old Marine sergeant by a sheriff's deputy was justified.

District Attorney Tony Rackauckas announced the findings Friday.

Sgt. Manuel Levi Loggins Jr. was shot to death at San Clemente High School after crashing a GMC Yukon through a gate of the school's parking lot, with his 14-year-old and 9-year-old daughters in the back seat.

Loggins' widow filed a wrongful death lawsuit in May, accusing Deputy Darren Sandberg of using excessive force.

The suit claims that her husband made no aggressive movements or gestures that would suggest he was armed.
