Two charter schools are suing the San Diego Unified School District. They say the district has illegally turned down their requests for classroom space. KPBS reporter Beth Ford Roth has more.

California's Proposition 39 requires school districts to provide charter schools with facilities comparable to other public schools within the district.

The lawsuit claims the district unfairly denied school facilities or even classroom space to Fanno Charter Academy and KIPP Adelante Charter School.

Fanno director Tameka McGlawn says her school is now housed in a small church, and that has caused problems attracting new students.

McGlawn: "Even parents who were interested were concerned about the space which affects not only the facility capacity, but philosophically what does it look like to house a school in a church."

A lawyer representing the district calls the lawsuit unnecessary. She says the new superintendent is committed to complying with Prop 39, and taking care of charter students. Beth Ford Roth, KPBS news.
