9 Still Missing After Smuggling Boat Capsizes

Lisa Ohmstede, with Scripps Memorial Hospital in La Jolla says a Guatemalan woman who was rushed to the hospital after Saturday's smuggling accident has been pronounced dead.

That brings the death toll for the boat that flipped off the coast of Torrey Pines State Beach to two. Customs and Border Protections spokeswoman Jackie Dizdul says a man died on the way to the hospital Saturday.

Alberto Diaz is a spokesman with the Mexican Consulate in San Diego. He says the consulate contacted the man's family in Jalisco.

"People are always expecting to hear from their loved ones when they made it to the US, that they made it safely. And, of course, in some cases that is not the case. Its always a tragic situation," says Diaz.

Diaz believes the nine people on the boat who've not been found made it to land and escaped arrest.

Meanwhile, federal immigration officials arrested two alleged smugglers who were on the boat. Officials say both are from Mexico. They were arraigned in federal court in San Diego.
