Marines to Hold Dismissal Hearing for Sgt. Gary Stein on Saturday

Sgt. Gary Stein, the Camp Pendleton Marine in hot water for writing anti-Obama Facebook posts, will get a dismissal hearing before a Marine Corps Administrative Separation Board (also called "AdSep") on Saturday.

Stein posted on his Facebook page this morning that his hearing was set for 8 a.m. Saturday at Camp Pendleton.

What is an AdSep? According to the Marine Corps website:

An administrative separation is the way the Marine Corps fires people. It is not punitive in nature like a court-martial... The only question in an AdSep is whether you will remain in the Marine Corps and (if you are actually separated) what the characterization of your service will be.

At issue is whether Stein violated the Uniform Code of Military Justice, particularly Article 88, which states:

Any commissioned officer who uses contemptuous words against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct.

As recently as this morning, Stein was still outspoken in his anti-Obama views, writing on Facebook:

Obamacare is simply the gateway to totalitarianism. It's the fastest way to get there. It should not be the position of anybody in government whether or not a family member of yours gets a pacemaker or medical treatment. That should be up to you and whoever your insurer is.
