State Assembly Judiciary Dems Approve Pro Same-Sex Marriage Bill

On a strict party line vote, Democrats in the Assembly Judiciary committee have approved a bill that would allow same sex marriage in California.   Despite threat of a veto if the bill makes it through the legislature, its author says he's making progress. From Sacramento, Jenny O'Mara reports.

State Assemblyman Mark Leno says there's more support than ever for his bill, but opponents who testified at the committee hearing cited an initiative approved by voters in 2000 that says marriage is between a man and a woman.

Jo Frick, from Jackson, California: I resent you going over the will of the people as in Proposition 22.

Governor Schwarzenegger has indicated he would veto the bill. But Leno insists it's an issue for the legislature.

Leno : No one's civil rights should be on a ballot -- that is why we have three branches of government. It's to protect the minority from the tyranny of the majority.

The bill was approved by the legislature but vetoed by the Governor in 2005. The issue is also being challenged in court.
