San Diego Lawyers Return to Court for Medical Marijuana Appeal

Lawyers representing San Diego County will once again try to overturn California's medical marijuana law. County attorneys will argue before the 4th District Court of Appeal tomorrow that the federal law making marijuana illegal should prevail. KPBS Reporter Kenny Goldberg has more.

The original suit was filed when a state law was passed requiring counties to issue ID cards to medical marijuana patients. San Diego County supervisors refused, and decided to sue the state. A Superior Court judge rejected that challenge in 2006. The County then filed an appeal. Attorney Joe Alford represents the advocacy group Americans for Safe Access. He says the County's argument doesn't hold water.

Alford: Well, federal law only trumps state law if there is a direct conflict between the two. And here there is no conflict. These two sets of laws have coexisted for about the last 12 years, and they can continue to coexist."

The 4th District Court of Appeal is expected to issue its ruling within 90 days.
